This Pouch is indorsed "Sessio tenta apud Turrim Londoniæ coram Thoma Duce Norfolciæ hac vice Senescallo Angliæ, anno regni regis Henrici Octavi vicesimo octavo." The main Records, containing thirteen membranes, on which are enrolled the proceedings in this case, are in good condition, but the other documents, numbered fourteen to twenty-one, have sustained much damage.

We, considering that justice is an excellent virtue and pleasing to the Most High, we wish to use it above all; and inasmuch as the office of the Seneschal of England, whose presence is required for the administration of justice and execution in this same part, to be received is already vacant, trusting more fully to your faithfulness and diligence, we have ordered and appointed you, for this cause and reasons, Seneschal of England to that office with all the same the office in this part of the duties pertaining, in this turn, to carry out, occupy and exercise, giving and granting to you according to the terms of the present full and sufficient power and authority and special mandate to the aforesaid lady Anne queen of England and George lord of Rocheford concerning all the things touching them by the aforesaid justices to receive the aforesaid of ours and their allies, and to inspect them, and to call before you the lady Anne, queen of England, and George, lord of Rocheford, at a certain day and place which you shall provide for this purpose, and to hear them and theirs both from above, and to address them to an examination and answer, and to conclude with due end; as well as so many such lords, nobles, and magnates of this kingdom of England, the same lady Anne, queen of England, and the peerage of George, lord of Rocheford, by whom the truth of the matter in this part may be better known, to appear before you at the day and place for the cause and reasons aforesaid, and to bind the truth found thence judgment from there to be rendered by you as our Seneschal of England in this part according to the law and customs of our kingdom of England, in this turn, towards the aforesaid lady Anne queen of England and George lord of Rocheford [and] to proceed, sentence and adjudge and order the execution from there to be ordered and everything else which belong to the office of the Seneschal of England in this part, and are required, in this turn, to be done, exercised, and executed.

And we ordered the same our justiciaries to deliberate upon you the aforesaid indictments with all those touching them for the aforesaid cause and reasons.

And this you have by no means omitted. Witness myself at Westminster on the thirteenth day of May in the twenty-eighth year of our reign.

It was ordered by the said Seneschal of England, that is to say, on the thirteenth day of May, in the twenty-eighth year aforesaid, to the aforesaid John Baldewyn, the soldier, and his associates, the executioners, &c. in the said county of Middlesex, that the indictments, records, and proceedings of high treason against the person of the lord the king were made and carried out, whereby the said lady Anne, queen of England, wife of the said lord the king, and George Boleyn, knight, Lord Rocheford, were indicted, with all touching them, so fully and completely as they were lately taken before them, and they then dwelt near them by whatever names the same lady the queen and Lord Rocheford were called in the same before the aforesaid Seneschal under their seals, or one of them at the Tower of the said lord the king of London on Monday the fifteenth day of May next coming, or one of them should send that further, &c. Precept was also by the said Senescall of England, namely, on the said thirteenth day of May in the twenty-eighth year aforesaid, to the aforesaid John Baldewyn, Walter Luke, Anthony Fitz-herbert, and William Shelley, soldiers, and their justiciary associates, &c. in the said county of Kent, that the indictments, records, and processes of high treason against the person of the lord the king have been made and executed, whereof the said lady Anne, queen of England, now the wife of the said lord the king, and George Boleyn, the knight, Lord Rocheford, have been indicted, with all touching them, so fully and completely as they were lately taken before them, and they dwelt near them, by whatever names the same lady, the queen, and Lord Rocheford were called in the same, before the aforesaid Seneschal, under their seals, either one of them should be sent to the said Tower of the said Lord King of London on Monday, the fifteenth day of May next next, or one of them to send further, &c.

And furthermore by the said Seneschal of England it was ordered on the aforesaid thirteenth day of May in the twenty-eighth year to the aforesaid constable of the said Lord King's Tower of London or his lieutenant or his deputy there that the bodies of the said Lady Anne Queen of England the wife of the said Lord the King now and George Boleyn, a soldier, Lord Rocheford . then he happened to order there. It was also commanded by the aforesaid Senescall of England, on the twenty-eighth day of May, to the aforesaid Ralph Felmyngham, servant of the said lord of the king, that he summon to arms so many and such lords, nobles, and magnates of this kingdom of England, the aforesaid lady Anne, queen of England, and Lord Rocheford, peers, by whom the truth of the matter is in on this side it may be better known that they themselves appear in person before the aforesaid Seneschal at the Lord King's Tower of London aforesaid on Monday, the fifteenth day of May next to come, to do what they shall be enjoined on the part of the Lord King at that time in the premises, &c.

He caused the summoners to appear in person before the aforesaid seneschal at the aforesaid day and place to do those things which were ordered to them on the part of the lord the king at that time in the premises, as was above given to him in the orders, &c.

An inquisition taken at the villein of Westminster in the aforesaid county on Wednesday next three weeks after Paschse, in the twenty-eighth of the reign of King Henry the Eighth, before John Baldewyn, knight, Richard Lyster, knight, John Porte, knight, John Spelman, knight, Walter Luke, knight, Anthony Fitzherbert, knight, and William Shelley, a soldier, to the justiciaries of the lord the king, by the king's open letters directed to them and others to inquire by the sacrament of honest and lawful men of the said county of Middlesex, under the liberties and outside, by whom the truth of the matter may be better known of any treasons, malices of treasons, rebellions, felonies, murders, murders, riots, riots, unlawful assemblies, insurrections, extortions, oppressions, contempts, concealments, ignorances, negligences, offenses, contempts, forgeries, deceptions, confederations, conspiracies, as well as accessory to the same and other transgressions and offenses of any kind under the county foretold by whatever you have done, done, perpetrated or committed; and assigned to hear and terminate the same treasons and other premises according to the law and customs of the kingdom of England, by the sacrament of Egidius Heron squire, Roger More squire, Richard Awnsham squire, Thomas Byllyngton squire, Gregory Lovell squire, John Worsop squire, William Goddard gent. Henry Lodysman, gent., and John Averey, gent. will have existed; and the same lady Anna, not only forbidding the most excellent and noble marriage between our lord the king and the don, the queen herself, insulting the celebrated queen, but also carrying malice in her heart towards the said lord our king, being seduced by diabolical instigation, not having God before her eyes and constantly following his fragile and carnal appetite and affecting that several of the aforesaid servants and family servants of our king would be adulterers and concubines during his reign, and would make them falsely treacherous and contrary to their legionary debt, by lewd conversations and kisses, touches, gifts, and various other nefarious instigations and incitements of his from time to time as his crime the ability to abolish the most falsified and most treacherous desires was procured. So much so that the most wicked and treacherous crime of adultery was committed against that same queen; some of the servants of the said master of the king, through the meanest provocation and incitement of the said queen, were now and then treacherously devoted and inclined to the same queen; that is to say, the said queen, on the sixth day of October, in the twenty-fifth year of the reign of our said lord the king, at the town of Westminster in the said county, and on various other days and times before and afterwards, a certain Henry Noreys, late of the town of Westminster, in the said county of Westminster, one of the gentlemen of the private chambers of the same lord the king treacherously procured and incited the queen to be violated and carnally known by sweet words, kisses, touches, and other unlawful ways and means, by which the same Henry Norreys, on the twelfth day of October in the year of the reign of the said lord the king, on the twenty-fifth occasion of the said lady's queen, treacherously incited and procured the same lady queen against the legions he treacherously violated, defeated, and carnally knew his debt at the said town of Westnionasteri in the said county. And that the same Henry Noreys on various other days and times before and afterwards at the aforesaid town of Westminster in the aforesaid county, sometimes by Henry's own agency of the aforesaid queen treasonably committed there and sometimes by the agency of the same Henry Noreys treasonably committed the aforesaid queen there he knew carnally. And that the aforesaid queen, on the second day of November in the twenty-seventh year of the reign of the said lord the king, and on various other days and times before and after, at the aforesaid town of Westminster in the aforesaid county, a certain George Boleyn, late of the town of Westminster in the aforesaid county, a soldier, Lord Rocheford, natural brother of the aforesaid queen and one of the gentlemen of the said private chamber of the said lord of the king to violate and carnally know the queen himself, and with the tongue of the queen in the mouth of the said George and the tongue of George himself, in the mouth of the said queen, with such kisses with the open mouth of the king and George with gifts and jests, as well as others He treacherously procured and incited by illicit ways and means, by which the same George, Lord Rocheford, in every way the precepts of Almighty God and every human being) rejecting the laws of nature, looking at the seductions and incontinences of the said queen, and knowing that on the fifth day of November in the twenty-seventh year of the reign of the said lord the king, the same queen his natural sister falsely, most detestably, and most treacherously against the debt of his legion at the aforesaid town of Westminster. in the aforesaid company he violated and knew carnally. And that the same George on different other days and times before and afterwards at the aforesaid town of Westminster in the aforesaid county, sometimes by George's own agency of the aforesaid queen treacherously committed there, and sometimes by the queen's own agency treacherously committed by the same George there treacherously violated, abused and carnally knew the aforesaid queen. And that the aforesaid queen, on the third day of December in the twenty-fifth year of the reign of our said lord the king, and on various other days and times before and after, at the aforesaid town of Westminster, in the aforesaid county, a certain William Bryerton, late of the town of Westminster, in the aforesaid county, esquire, and one of the gentlemen of the said privy chamber he treacherously procured and incited the aforesaid master of the king to violate the queen herself and to know her carnally by kisses, touches, and other illicit ways and means. By which the same William Bryerton, on the eighth day of December in the twenty-fifth year of the reign of the said lord the king, on the occasion of the treasonable incitement and procuring of the said lady queen, treacherously raped, defrauded and carnally assaulted the same queen against the debt of her legions at Hampton Court in the parish of Lytel Hampton in the said county. And that the same William Bryerton on various other days and times before and afterwards at the aforesaid town of Wetmonastery in the aforesaid county, sometimes by William's own agency of the aforesaid queen treacherously committed there, and sometimes by the queen's agency the same William treacherously violated the aforesaid queen . And that the said queen, on the eighth day of the month of May, in the twenty-sixth year of the reign of our said lord the king, and on various other days and times before and after, at the aforesaid town of Westminster, in the aforesaid county, a certain Francis Weston, late of the town of Westminster, in the aforesaid county, a soldier, and one of the gentlemen of the aforesaid privy chamber of the king's lord &c.

And that the aforesaid queen, on the aforesaid thirteenth day of May, in the twenty-sixth year of the reign of the said lord the king, and on various other days and times before and afterwards, at Est Grenewyche, in the aforesaid county, a certain Marcus Smeton, late of Est Grenewyche, gent, in the aforesaid county, and one of the grommets of the said private chamber, &c. by which the same Marcus Smeton on the nineteenth day of May in the said year of the reign of the said lord the king twenty-sixth, &c.

Sicque præfati juratores dicunt quod præfata regina et ceteri proditores prænominati proditiones suas prædictas ut præmittuntur false et proditorie commiserunt et perpetraverunt in dicti domini nostri regis coronæ suæ regiæ et totius regni sui Angliæ contemptum manifestum et derogationem et regalis personæ et corporis dicti domini regis periculum ac in proditorium scandalum, periculum, detrimentum et derogationem exitus et heredum dictorum domini regis et reginæ et contra pacem ejusdem domini regis, &c.
And moreover the aforesaid jurors say that the aforesaid George Boleyn the soldier, Lord Rocheford, Henry Noreys, William Bryerton, Francis Weston, and Marcus Smeton, were so inflamed and inflamed by the carnal love of the said queen that one of them desired and affected the said queen more, and another of them reviled and indignantly they muttered to each other in their hearts, one against the other, suspicious and jealous, &c. Since then, with the same queen, committing and perpetrating at Eltham in the aforesaid county on the last day of December in the twenty-seventh year of the reign of the said lord the king, and on various other days and times before and after, he treacherously contributed, gave, and was lavished. On whose pretext the said queen treacherously aided and strengthened the aforesaid traitors in their said treasons then and there; and the aforesaid queen and the other forenamed traitors adhering to the same queen according to the manner of the aforesaid treacherous vices, viz. afterwards, at Est Grenewich, in the aforesaid county, the death and destruction of the aforesaid lord our king, treacherously against the debt of his legions, they conspired and imagined. Thus the said queen often said and promised that she would marry one of the aforesaid traitors whenever the said lord king happened to depart from this world, affirming that she would never love the lord king himself in her heart. And the same our lord the king aforesaid the most falsified and abrogated crimes, vices, and treasons against him in such a manner as are prescribed committed and perpetrated within a short time now past, by the supreme grace of God interceding, recognizing and weighing within himself such hearty ingratitude and sadness, especially from his said queen and by the consorts who had expended on him malice and adultery by treacherous agency, and also received from the said servants of his chamberlains the most worthy of his royal person, who were nearest to his royal person; And so the aforesaid jurors say that the aforesaid queen and the other aforesaid traitors have falsely and treasonably committed their aforesaid treasons, and perpetrated in our said lord the king a manifest contempt and derogation of the crown of his kingdom and of his whole kingdom of England, and a royal danger to the person and body of the said lord the king, and in treacherous scandal, danger, loss, and derogation of the issue and heir of the said lord king and queen, and against the peace of the same lord king, &c.

And afterwards on the same instant, on Monday, the fifteenth day of May, before the aforesaid Thomas, Duke of Norfolk, this time Seneschal of England, at the aforesaid Tower of London, came the aforesaid Lady Anne, Queen of England, under the custody of the aforesaid William Kyngeston, a soldier, constable of the same Tower, in whose custody for reasons aforesaid and for other certain reasons, by the command of the said lord the king, she was committed by virtue of the brief and precepts aforesaid, and brought here to the bar in her own person; and hence he places himself above his equals in regard to good and evil, &c.
Super quo prædicti Dux Suffolciæ, Marchio Exoniæ, ac comites et barones, prædictæ dominæ reginæ pares instanter super eorum fidelitatem et ligeantiam dicto domino regi debitam per præfatum Senescallum Angliæ de veritate inde dicenda onerati; et postea per eundum Senescallum Angliæ ab inferiore pare usque ad supremum parium illorum separatim inde examinati. Whereupon the aforesaid Duke of Suffolk, the Marquis of Exon, and the earls and barons, equals of the aforesaid queen, were instantly charged with their fidelity and loyalty to the said lord the king, by the aforesaid seneschal of England, of the truth to be said therefrom; and afterwards, by going to the seneschal of England, from the lowest peer to the highest peer of them, they were separately examined thence. Each of them separately says that the aforesaid lady queen is guilty of the aforesaid treasons imposed upon her in the manner and form as is supposed by the separate indictments aforesaid, &c.

Because of this, the servants of the lord the king at law and the attorney of the lord the king himself, according to the due form of the law, request against the same lady queen a judgment and execution to be held on behalf of the said lord the king, &c.
Et super hoc, visis et per curiam hie intellects omnibus et singulis præmissis, consideratum est quod prædicta regina ducatur per præfatum constabularium, &c. usque prisonam dicti domini regis infra eandem Turrim; et deinde ad mandatum ejusdem domini regis usque le Grene infra dictam Turrim ducatur et ibidem comburetur vel caput ejus amputetur prout superinde domino regi placuerit, &c.
And upon this, having seen and understood by the court here all and every one of the foregoing, it was considered that the aforesaid queen should be taken by the aforesaid constable, &c. even the prison of the said lord of the king below the same Tower; and then, by command of the same lord the king, shall be taken to Le Grene, below the Tower, and there burned or decaptiated, as it pleased the king above, &c.

Whereupon the aforesaid Duke [of Suffolk], the Marquis of Exon, and all the earls and barons of the aforesaid earl of Northumbria, on account of the sudden infirmity of his body, only excepting and in the absence of the aforesaid lord Eocheford, are immediately equal upon their fidelity and allegiance due to the said lord to the king, by the aforesaid seneschal of England of truth from thence it is to be said that they were charged and afterwards separately examined by the same Seneschal of England from the lowest peer to the highest peer of them. Each of them separately says that the aforesaid Lord Rocheford is guilty of the aforesaid treasons charged against him in the manner and form jaccording to the aforesaid separate indictments, &c. Because of this, the servants of the said lord the king at law and the king's attorneys, according to the due form of the law, request against the same lord Rocheford a judgment and execution on behalf of the said lord the king, &c. And upon this, having been seen and understood by the court here by each and every one of them, it is agreed that the aforesaid Lord Rocheford shall be taken by the aforesaid constable, &c. even the prison of the said lord of the king below the same Tower. And then he shall be dragged through the middle of the city of London to the gallows of Tyburn, and there be hanged, and while alive prostrated to the ground, and his entrails taken outside his belly, and while he is still alive, burned. And that his head should be cut off, and that his body should be divided into four parts, and that the head and quarters should be placed where the lord the king wished to assign them, &c. In this same Pouch (IX.) are the originals of several of the documents entered on the above enrolment; most of them are considerably damaged, and, as they contain no new information except the endorsements, it is not requisite here to reproduce them. They are strung on a file promiscuously in the order indicated by the numbers in the margin, but are here arranged chronologically so far as each session is concerned, that for Middlesex preceding Kent.

Original Commission appointing Thomas Duke of Norfolk, Treasurer, and Earl Marshal of England, to the office of Lord High Steward of England, to receive the indictments found against Queen Anne and the Lord Rochford, and to call them before him for the purpose of hearing and examining them and compelling them to answer thereto, being identical with the Letters Patent already copied from the enrolment. This parchment is the fourth on the file, and has an impression of the Great Seal appended.

13 May 28 Hen 8 (M.19). Precept addressed by the Lord High Steward to Sir John Baldewyn and his fellows, commanding them to return the indictment before him at the Tower on Monday, the 15th May. 15 May 28 Hen 8 (M.15). A portion of the orginal panel of the Peers, annexed to the preceding Precept. In this panel the name of "Thomas" Lord Dacre is written in place of William, which is crossed through; this was probably a mistake of the scribe, who had confused Thomas Lord Dacre with William Lord Dacre of the North, who were both then living, but only the former sat upon the trial. The names of the Peers are pricked off in the margin, evidently as they came in, and against each name is written the abbreviated word "Cul'" twice repeated in the handwriting of the Lord High Steward, being evidently the answer "culpabilis" upon each arraignment. Only 17 of the names are now left, commencing with the Earl of Sussex, the upper part of the strip of parchment having entirely perished.
