Thomas Overbury Murder and Trial of his Murderers

Letters of the Court of James I 1613 Reverend Thomas Lorkin to Sir Thomas Puckering Baronet 12 Aug 1613. 12 Aug 1613. London. Reverend Thomas Lorkin to Thomas Puckering 1st Baronet (age 21).

First, touching the business which you so particularly commended unto me at our last being together at Florence, Italy, I have had hitherto very small opportunity of dealing farther in it than pressing Mr. Newton (age 33) for his advice and furtherance. For in this general absence of the court, when king, queen, and prince are all in several progresses, little or no means hath been yet offered. Sir Robert Cary (age 53)1, as your brother telleth me, is the fittest man to be dealt with in that kind, to whom I shall most willingly likewise address myself, as having best means to him. Only I attend some further directions from Mr. Newton (age 33) both for the nature of the place I should sue for, and how I should govern myself in my offers for the accomplishment of it.

For news, that which is of chiefest moment is this. There hath lately happened in the Palatine's court a strange quarrel between the English and Scots, and that in this manner and upon this occasion. Sir Andrew Keigh, a Scotsman, that is in some office about the Palatine, happening one day to contest with my Lady Harrington (age 59)2 upon some point in her grace's presence, [he proceeded] to that insolency at the length, as he gave her the lie; and not content therewith (to verify that of the orator, "qui vere cundiæ fines semel transierit, eum benè et gnavitèr oportet esse impudentem," [Note. she who truly has once crossed the bounds of grace must be shameless]) fell to debase my lord (age 73) likewise with very base and opprobrious speeches. Mr. Bushell, who, as I understand, was the only man of all my lord's followers that was then present, finding Keigh not long after in a fit place for that purpose, offered him the combat in defence of his lord's (age 73) and lady's (age 59) honour; and as both were ready to draw, another Scotsman, who was in Keigh's company, interposed himself, and suffered not them to proceed then any farther. Being thus parted, my Lord Harrington (age 73) sent for Mr. Bushell to his chamber (whether to wish him to be quiet, or for what other occasion I know not). In the mean time, this Keigh [at the] head of four or five Scotsmen more, himself being provided, besides his sword, with a square bastinado and a dagger, the rest with the [sword] only, lies in wait to set apon Mr. Bashell at his return: [who, as he was] coming from my lord, and not dreaming of any such enterprise, and going to put his foot in his stirrup to mount up upon his horse, (for my lord's [lodging and his] were far asunder), lo! Keigh steps forth, striking him, [and with the] bastinado fells him: yet presently he recovered himself, and, offering to rise, received a second blow upon the head, and was felled a second time. Notwithstanding all this, he recovered himself again, and drew out his sword in his own defence, being all idone; when all the rest laid about him with their swords, and, being five to one, wounded him very grievously, as having run him through the body, and into divers parts no less than twelve times. During this conflict, Mr. Gray, another of my lord's gentlemen, coming forth, received a thrust in the hand, but not without leaving some of the marks likewise upon them. After that came her grace's coachman, and took part with Mr. Gray (for Mr. Bushell was now left for dead) and hurt two or three of the Scots; who, not daring to abide to fight any longer, partly for fear of others that might come in, and partly for that they supposed their chief enemy either dead or not likely to live, presently quitted the place, and betook themselves to flight. But there was suddenly way made after them, and they all brought back again. Sir Andrew Keigh was confined to his chamber under a sure guard, the rest committed to the ordinary prison; and a messenger presently despatched over into England to understand his majesty's pleasure touching this subject; who has scarcely as yet received the news thereof. Mr. Bushell nevertheless is yet living, and not without hope of recovery. My Lord (age 73) and Lady Harrington (age 59) purpose to return for England this month, and to bring him along with them, (which they may well do by water) if they find him any way able to endure it.

Upon their arrival. Sir John Harrington (age 21)3 purposeth to go and take possession of his government in Guernsey [Map], which he hath lately obtained by an exchange which he hath made between it and a reversion of an office formerly granted him of being master in the King's Bench.

My Lord of Essex's (age 22) cause hath had no hearings of late, and is remitted over to the 18th day of this next new month. Two new commissioners are adjoined to the former, viz., the Bishops of Winchester (age 66)4 and Rochester (age 51)5 that their voice in favour of the nullity may be able to counterpoise the contrary opposition of Canterbury and London.

The Lord Chief Justice Fleming (deceased) is lately dead, and Hobart and Montagu suitors for the place.

In my last letters I acquainted you with the stirs that were at Nismes upon occasion of M. Ferrier, some time their minister. M. le Conestable, who resides in those parts, hath made such a grievous complaint thereof unto the queen (age 11)6, as she hath taken a resolution thereupon to translate, by way of punishment, the presidial seat of justice, which is there, to Beaucaire, a neighbour Catholic town, hard by; which, if it once come to be put in execution, is like to occasion far greater stirs in those quarters.

Evelyn's Diary. 05 Dec 1643. The Earl of Norwich (age 58) came as Ambassador extraordinary: I went to meet him in a coach and six horses, at the palace of Monsieur de Bassompière, where I saw that gallant person, his gardens, terraces, and rare prospects. My lord was waited on by the master of the ceremonies, and a very great cavalcade of men of quality, to the Palais Cardinal, where on the 23d he had audience of the [her son] French king (age 5), and the queen Regent his mother (age 42), in the golden chamber of presence. From thence, I conducted him to his lodgings in Rue St. Denis, and so took my leave.

Memoirs of Jean Francois Paul de Gondi Cardinal de Retz Book 1. Before 18 Jan 1649. To return to the war. A cornet of my regiment being taken prisoner and carried to Saint Germain, the Queen (age 47) immediately ordered his head to be cut off, but I sent a trumpeter to acquaint the Court that I would make reprisals upon my prisoners, so that my cornet was exchanged and a cartel settled.

Evelyn's Diary. 19 Aug 1649. I went to salute the [her son] French King (age 10) and the Queen Dowager (age 47); and, on the 21st, returned in one of the Queen's coaches with my Lord Germain, Duke of Buckingham (age 21), Lord Wentworth (age 37), and Mr. Croftes (age 38), since Lord Croftes.

Evelyn's Diary. 06 May 1651. I attended the ambassador to a masque at Court, where the French King in person danced five entries, but being engaged in discourse, and better entertained with one of the Queen-Regent's (age 49) secretaries, I soon left the entertainment.

Evelyn's Diary. 07 Sep 1651. I went to visit Mr. Hobbes (age 63), the famous philosopher of Malmesbury, Wiltshire [Map], with whom I had long acquaintance. From his window we saw the whole equipage and glorious cavalcade of the young French Monarch, [her son] Louis XIV (age 13), passing to Parliament, when first he took the kingly government on him, now being in his 14th year, out of his minority and the Queen Regent's (age 49) pupilage. First came the captain of the King's Aids, at the head of 50, richly liveried; next, the Queen-Mother's Light Horse, 100, the lieutenant being all over covered with embroidery and ribbons, having before him four trumpets habited in black velvet, full of lace, and casques of the same. Then, the King's Light Horse, 200, richly habited, with four trumpets in blue velvet embroidered with gold, before whom rode the Count d'Olonne coronet [cornet], whose belt was set with pearl. Next went the grand Prévôt's company on foot, with the Prévôt on horseback; after them, the Swiss in black velvet toques, led by two gallant cavaliers habited in scarlet-colored satin, after their country fashion, which is very fantastic; he had in his cap a pennach of heron, with a band of diamonds, and about him twelve little Swiss boys, with halberds. Then, came the Aide des Cérémonies; next, the grandees of court, governors of places and lieutenants-general of provinces, magnificently habited and mounted; among whom I must not forget the Chevalier Paul, famous for many sea-fights and signal exploits there, because it is said he had never been an Academist, and yet governed a very unruly horse, and besides his rich suit his Malta Cross was esteemed at 10,000 crowns. These were headed by two trumpets, and the whole troop, covered with gold, jewels, and rich caparisons, were followed by six trumpets in blue velvet also, preceding as many heralds in blue velvet semée with fleurs-de-lis, caduces in their hands, and velvet caps on their heads; behind them, came one of the masters of the ceremonies; then, divers marshals and many of the nobility, exceeding splendid; behind them Count d'Harcourt, grand Ecuyer, alone, carrying the King's sword in a scarf, which he held up in a blue sheath studded with fleurs-de-lis; his horse had for reins two scarfs of black taffeta.

Evelyn's Diary. 07 Sep 1651. Then came abundance of footmen and pages of the King, new-liveried with white and red feathers; next, the garde du corps and other officers; and lastly, appeared the King himself on an Isabella barb, on which a housing semee, with crosses of the Order of the Holy Ghost, and fleurs-de-lis; the King himself, like a young Apollo, was in a suit so covered with rich embroidery, that one could perceive nothing of the stuff under it; he went almost the whole way with his hat in hand, saluting the ladies and acclamators, who had filled the windows with their beauty, and the air with Vive le Roi. He seemed a prince of a grave yet sweet countenance. After the King, followed divers great persons of the Court, exceeding splendid, also his esquires; masters of horse, on foot; then the company of Exempts des Gardes, and six guards of Scotch. Between their files were divers princes of the blood, dukes, and lords; after all these, the Queen's guard of Swiss, pages, and footmen; then, the Queen-Mother (age 49) herself, in a rich coach, with Monsieur the King's brother, the Duke of Orléans, and some other lords and ladies of honor. About the coach, marched her Exempts des Gardes: then the company of the King's Gens d'armes, well mounted, 150, with four trumpets, and as many of the Queen's (age 49); lastly, an innumerable company of coaches full of ladies and gallants. In this equipage, passed the monarch to the Parliament, henceforth exercising his kingly government.

Evelyn's Diary. 15 Sep 1651. I accompanied Sir Richard Browne (age 46), my father-in-law, to the French Court, when he had a favorable audience of the [her son] French King (age 13), and the Queen (age 49), his mother; congratulating the one on his coming to the exercise of his royal charge, and the other's prudent and happy administration during her late regency, desiring both to preserve the same amity for his master, our King, as they had hitherto done, which they both promised, with many civil expressions and words of course upon such occasions. We were accompanied both going and returning by the Introductor of Ambassadors and Aid of Ceremonies. I also saw the audience of Morosini, the Ambassador of Venice, and divers other Ministers of State from German Princes, Savoy, etc. Afterward I took a walk in the King's gardens, where I observed that the mall goes the whole square there of next the wall, and bends with an angle so made as to glance the wall; the angle is of stone. There is a basin at the end of the garden fed by a noble fountain and high jetto. There were in it two or three boats, in which the King now and then rows about. In another part is a complete fort, made with bastions, graft, half-moons, ravelins, and furnished with great guns cast on purpose to instruct the King in fortification.

Evelyn's Diary. 01 Oct 1651. The Dean of Peterborough (age 56) [Dr. Cosin] preached on Job xiii., verse 15, encouraging our trust in God on all events and extremities, and for establishing and comforting some ladies of great quality, who were then to be discharged from our Queen-Mother's (age 50) service unless they would go over to the Romish Mass.

In 1660 [her son] Louis "Sun King" XIV King France (age 21) and [her daughter-in-law] Maria Theresa of Spain Queen Consort France (age 21) were married. She by marriage Queen Consort of France. She the daughter of Philip IV King Spain (age 54) and Elisabeth Bourbon Queen Consort Spain. He the son of Louis XIII King France and Anne of Austria Spain Queen Consort France (age 58). They were double first cousins.

On 02 Feb 1660 [her former brother-in-law] Gaston Bourbon (age 51) died.

On 31 Mar 1661 [her son] Philip Bourbon I Duke Orléans (age 20) and [her daughter-in-law] Princess Henrietta Stewart Duchess Orléans (age 16) were married. She by marriage Duchess Orléans. She the daughter of King Charles I of England, Scotland and Ireland and Henrietta Maria Bourbon Queen Consort England (age 51). He the son of Louis XIII King France and Anne of Austria Spain Queen Consort France (age 59). They were first cousins.

Pepy's Diary. 02 Jul 1663. Walking in the garden this evening with Sir G. Carteret (age 53) and Sir J. Minnes (age 64), Sir G. Carteret (age 53) told us with great contempt how like a stage-player my Lord Digby (age 50) spoke yesterday, pointing to his head as my Lord did, and saying, "First, for his head", says Sir G. Carteret (age 53), "I know what a calf's head would have done better by half for his heart and his sword, I have nothing to say to them". He told us that for certain his head cost the late King his, for it was he that broke off the treaty at Uxbridge. He told us also how great a man he was raised from a private gentleman in France by Monsieur Grandmont1, and afterwards by the Cardinall, [Mazarin] who raised him to be a Lieutenant-generall, and then higher; and entrusted by the Cardinall, when he was banished out of France, with great matters, and recommended by him to the Queen (age 61) as a man to be trusted and ruled by: yet when he came to have some power over the Queen, he begun to dissuade her from her opinion of the Cardinal; which she said nothing to till the Cardinal was returned, and then she told him of it; who told my Lord Digby (age 50), "Eh bien, Monsieur, vous estes un fort bon amy donc2" but presently put him out of all; and then he was, from a certainty of coming in two or three years' time to be Mareschall of France (to which all strangers, even Protestants, and those as often as French themselves, are capable of coming, though it be one of the greatest places in France), he was driven to go out of France into Flanders; but there was not trusted, nor received any kindness from the Prince of Conde (age 41), as one to whom also he had been false, as he had been to the Cardinal and Grandmont. In fine, he told us how he is a man of excellent parts, but of no great faith nor judgment, and one very easy to get up to great height of preferment, but never able to hold it.

Note 1. Antoine, Duc de Gramont, marshal of France, who died July 12th, 1678, aged seventy-four. His memoirs have been published.
